The Gunbarrel Retail Core Plan Intergovernmental Agreement was executed on May 18, 2006.
It is signed by the Mayor of the City of Boulder, the three County Commissioners, and their
respective clerks and attorneys.
Item 3 of this agreement contains the following language: "County agrees to approve,
concurrent with approval of this Agreement and Plan, the pending land use map changes for
the Gunbarrel Plan area that are shown on Exhibit B." This Exhibit B identifies: 1- the
contiguous properties north of Lookout Road, east of the Diagonal Highway, and south of
the ditches; 2- the properties immediately west of Spine Road and across from King Soopers;
and 3- the properties immediately south and east of King Soopers along Gunpark Drive. This
approval by the County authorizes the zoning changes necessary to implement the Gunbarrel
Community Center Plan.
Item 4 of this agreement contains the following language: "...buildings located or
developed along Spine Road in the designated area as shown on Exhibit A shall not be
permitted to exceed 3 stories in height, unless this IGA is amended by agreement of the
Parties." This Exhibit A identifies the properties immediately east and west of Spine Road
between Lookout Road and Gunpark Drive. This provision settles the issue of building height
in the King Soopers Shopping Center and across Spine Road from the shopping center.
Item 5 of this agreement contains the following language: "The Gunbarrel Plan permits
development of some buildings with some fourth story elements, on the property shown on
Exhibit A as the area east of the Spine Road properties. Development plans for this area
that include fourth story elements that exceed 25% in area of any building's footprint
(for the purposes of this Agreement, referred to as "3.25 stories") will be subject to
review and determination by the county and review and approval by the City." This Exhibit
A identifies the largely undeveloped land east of the King Soopers Shopping Center, south
of Lookout Road, and north and west of Gunpark Drive. This provision gives the County
parties approval rights over fourth story building extent. In fact, Exhibit A contains
the following caption regarding this property: "Building heights above plan thresholds
(3.25 stories) must be approved by City and County."
The remainder of this IGA defines in detail how the City must include the County in the
approval process "for all development in the retail core that exceeds 3.25 stories."
So, Boulder County will be involved in the approval process for any building with
a fourth story that occupies more than 25% of that building's footprint. Conversely,
Boulder County will not be involved in the approval process for any building with
a fourth story that occupies less than 25% of that building's footprint or for buildings
of less than four stories.
